I. Privacy Policy

2. General Information on Data Processing
We process personal data only to the extent necessary to provide our online store, to
process orders, to communicate with customers, to fulfill contracts, to
process payments, to arrange delivery, to comply with legal obligations, or based on
consent.
Personal data refers to any information relating to an identified or identifiable
natural person.

3. Conclusion of the Contract
The presentation of products in the online store does not constitute a legally binding offer, but rather an
invitation to place an order.
The customer may initially add products to the shopping cart without obligation and review and modify their entries at
any time before submitting the order.
By clicking the “Place Order” button or a similarly clearly
labeled button, the customer submits a binding offer to conclude a purchase contract
.
Upon receipt of the order, the customer receives an automatic confirmation of receipt. This
confirmation of receipt does not constitute acceptance of the offer unless it expressly states
that the offer has been accepted.

The contract is concluded when GEO Gallery expressly confirms the order, ships the goods,
or sends the customer a shipping confirmation.

4. Product Information, Authenticity, and Images
GEO Gallery strives to present the works on offer as accurately as possible. Minor
discrepancies between product images and the original work—particularly with regard to color,
brightness, texture, the appearance of the material, framing, perceived size, or surface appearance—may
be due to technical reasons and do not constitute a defect, provided they are reasonable.
The information provided in the respective product description is authoritative. This may include, in particular,
details regarding the artist, title, technique, material, dimensions, year of creation, edition, condition, delivery time, and
availability.
If a certificate of authenticity, a signature, a statement of provenance, or other documentation
is included in the offer, this will be specified in the respective product description.

5. Custom-Made and Personalized Items
Custom-made items, personalized items, or other items that are manufactured, modified, or adapted according to the
customer’s individual specifications are expressly identified as such
in the online store.
For such items, the production, coordination, and
delivery times specified in the respective offer apply.
The customer is obligated to provide all information necessary for the custom-made item completely and accurately.
Delays attributable to incomplete, incorrect, or late information provided by the customer
shall not be the responsibility of GEO Gallery.
For custom-made and personalized works, the statutory right of withdrawal
may be excluded. Details are provided in the separate withdrawal policy.

6. Prices, Shipping Costs, Customs Duties, and Import Taxes
Unless otherwise indicated, all prices listed in the online store are in euros
and include the applicable value-added tax.
Any additional shipping costs will be displayed to the customer during the ordering process
before the order is placed.
Delivery is available worldwide, provided that no
delivery restrictions are specified in the respective offer or during the ordering process.
For deliveries outside the European Union, additional customs duties, import sales tax,
taxes, fees, or other public charges may apply. These costs are to be borne by the customer,
unless they are expressly covered by GEO Gallery during the ordering process.
The customer is solely responsible for informing themselves about any import regulations, customs regulations, and
local charges in the country of delivery.

7. Payment

Payment is made using the payment methods offered in the online store.
Payment processing can be handled via Shopify Payments and/or other payment service providers
integrated through Shopify.
The following payment methods may be offered: specific payment methods, e.g., credit card, PayPal,
Apple Pay, Google Pay, Shop Pay, Klarna, Sofortüberweisung, prepayment, etc.
The payment methods available in each specific case are displayed to the customer during the ordering process.
GEO Gallery reserves the right to exclude certain payment methods on a case-by-case basis.

8. Delivery and Shipping
Delivery will be made to the shipping address provided by the customer.
The customer is required to provide a complete and accurate shipping address.
Delivery times are specified in the respective product description or in the order confirmation.
Longer delivery times may apply for original works, one-of-a-kind pieces, custom-made items, international shipping, or shipping handled by
artists or partners.
Shipping may be handled by GEO Gallery, the respective artist, a partner, or
a contracted shipping service provider.
Shipping service providers: specific shipping service providers / art freight forwarders / logistics partners
Partial deliveries are permitted, provided they are reasonable for the customer.
9. Transfer of Risk and Transport Damage
If the customer is a consumer, the risk of accidental loss and accidental
deterioration of the goods does not pass to the customer until the goods are handed over to the customer or to a
designated recipient named by the customer.
If the customer is a business, the risk passes to the customer as soon as GEO Gallery, the artist,
or another shipping partner has properly handed over the goods to the shipping service provider
The customer is requested to report any obvious shipping damage to the delivery agent as soon as possible
and to inform GEO Gallery thereof. For consumers, this does not constitute a prerequisite
for asserting statutory rights.

10. Retention of Title
The goods remain the property of GEO Gallery or, where applicable,
the respective rights holder or artist until full payment has been made.
With respect to business customers, GEO Gallery reserves title to the goods until full
settlement of all claims arising from the ongoing business relationship.
11. Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal for distance sales contracts.
Details are set forth in the separate withdrawal policy.
In particular, the right of withdrawal does not apply to contracts for goods that are not prefabricated and
for whose production an individual selection or specification by the consumer is decisive
or that are clearly tailored to the consumer’s personal needs.

This applies in particular to products expressly designated as custom-made, personalized works, or works
manufactured individually according to customer specifications.

12. Returns
Details regarding the exercise of the right of withdrawal, returns, and the return address
are set forth in the separate withdrawal policy and the return information.
Unless a different return address is specified in individual cases, returns must be sent to the following

Customers are asked to notify us in advance of any returns at
info@geogalleryberlin.de  to ensure proper
processing. For consumers, this prior notification is not a
prerequisite for the effective exercise of the right of withdrawal.
13. Warranty
The statutory rights regarding liability for defects apply.
In the case of used items, vintage items, one-of-a-kind pieces, handmade items, or items with
traces typical of their age, material, or manufacturing process, such characteristics do not constitute a defect,
provided they are specified in the product description, are customary for the type of item, or are
recognizable to the customer.
For business customers, the warranty period for new goods is one year from the transfer of risk,
unless mandatory statutory provisions provide otherwise. Liability for
claims for damages resulting from injury to life, limb, or health, as well as for intentional
conduct or gross negligence, remains unaffected.

14. Copyrights and Rights of Use
Upon purchasing a work of art, design object, or other tangible work, the
customer acquires, unless expressly agreed otherwise, only ownership of the tangible
work.
Copyrights, exploitation rights, reproduction rights, exhibition rights, publication rights,
and other rights of use are transferred only if this has been expressly agreed to in writing.
Without the prior consent of the respective rights holder, the customer is not authorized to
reproduce the work, exploit it commercially, make it publicly available, use it as a template for commercial
purposes, or use it in any other way that goes beyond private use.
15. Online Store Content
Texts, images, photographs, logos, graphics, designs, and other content of the online store are
protected by copyright or other intellectual property rights.
Any use, reproduction, modification, publication, or commercial exploitation is prohibited without
the prior consent of GEO Gallery or the respective rights holder.

16. Customer Account
If the online store allows customers to create an account, the customer is obligated to
keep their login credentials confidential and protect them from access by third parties.
The customer is obligated to notify GEO Gallery immediately if there are indications of
unauthorized use of their customer account.
17. Newsletter
If GEO Gallery offers a newsletter, it will be sent only with the customer’s separate consent.
The customer may revoke their consent at any time with future effect.
Details are provided in the Privacy Policy.

18. Gift Certificates, Digital Products, and Events
If GEO Gallery offers gift certificates, digital products, downloads, online content, events, or
services in the future, supplementary terms and conditions shall apply, which will be communicated in the respective offer or during the
ordering process.
Special statutory cancellation provisions may apply to digital content or services.
These will be communicated separately to the customer prior to the conclusion of the contract.
19. Liability
GEO Gallery bears unlimited liability in cases of willful misconduct and gross negligence, in cases of injury to life,
body, or health, under the Product Liability Act, and in all other cases of mandatory
statutory liability.
In the event of a breach of essential contractual obligations due to slight negligence, GEO Gallery’s liability is
limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are
those obligations whose fulfillment is essential for the proper performance of the contract
and on whose compliance the customer may regularly rely.
In all other respects, GEO Gallery’s liability is excluded.
The foregoing liability provisions also apply in favor of the legal representatives, employees,
vicarious agents, and agents of GEO Gallery.

20. Dispute Resolution
GEO Gallery is neither obligated nor willing to participate in dispute resolution proceedings before a
consumer arbitration board, unless required by law.
21. Contract Language and Storage of the Contract Text
The contract language is German.
GEO Gallery is not required to permanently store the contract text in a manner accessible to the customer
after the contract is concluded. The customer may save or print the order details and these Terms and Conditions
before submitting the order. After the order is completed, the customer will receive the essential
contract details via email.
22. Governing Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
With respect to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory
provisions of the law of the country in which the consumer has his or her habitual residence.

23. Place of Jurisdiction
If the customer is a merchant, a legal entity under public law, or a special fund under public law,
the place of jurisdiction for all disputes arising from or in connection with the
contractual relationship is Berlin.
The same applies if the customer does not have a general place of jurisdiction in Germany or if the customer
transfers his or her domicile or habitual residence abroad after the conclusion of the contract.
24. Final Provisions
Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, the
validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by the applicable statutory provisions.
